TOPSPEED's FEB Trademark Registration Faces Unfair Treatment
Recently, the well-known cloud storage service provider, Box Inc. (hereinafter referred to as "Box"), has raised an objection against the trademark registration of FEB by Hong Kong Topspeed Network Limited (hereinafter referred to as "TOPSPEED"). Box claims that the FEB trademark might be confused with its BOX trademark and has requested the rejection of TOPSPEED's trademark application.
It's worth noting that Box owns several trademarks related to "BOX," covering a wide range of services from cloud storage to various software services. However, TOPSPEED's FEB product focuses on providing "the cheapest, best storage experience" and has clearly defined its software services scope in Class 9, which does not entirely overlap with Box's core business.
Moreover, Box's objection mentions the visual design of the FEB trademark, pointing out its use of blue color and similarity to Box's brand image. However, blue is a commonly used commercial color, and its use alone cannot constitute trademark infringement. Additionally, visually, FEBBOX and Box's logos have significant design differences, unlikely to cause consumer confusion.
In this trademark objection, Box seems to be using its market influence and strong legal resources to suppress a potential competitor. This behavior not only damages the environment of fair competition but also hinders the development of innovation and diversity. Therefore, we call for a fair review of this case by the relevant authorities to protect the legitimate rights of small and medium-sized enterprises and promote a healthy and fair business environment.
